A recent court ruling is causing many employers to take a second look at how they classify and pay high-earning employees—and for good reason.

In April, the 6th Circuit joined the 5th Circuit in confirming that employees earning well over six figures may still be entitled to overtime if they’re not paid on a salary basis. In other words, compensation alone isn’t enough to exempt someone from OT requirements under the Fair Labor Standards Act (FLSA).

This ruling reinforces the importance of understanding the salary basis test and how it applies to your workforce. It’s not just about hitting a certain number—it’s about how that number is paid.

For example:

  • Are your managers and consultants paid a guaranteed weekly salary?
  • Or are they compensated by the hour or per project, even if their earnings are high?

If it’s the latter, you may be out of compliance—and exposed to risk.
